He asked for Pardon here is the report:
Date of receiving application 18 Jun 1917, sentenced 20 years for the crime of robbery.
Committed robbery 23 Nov 1916 in Stockton, CA.
He entered a second hand store about 9 pm pretending to buy a overcoat. He said he struck the victim first blow with an iron bar 18 inches long and 3/4 inches thick. Then there was a second blow, they stole goods valued at $100 and $69 in cash. He was arrested as he was leaving the Pittsburg Jail, spending 30 days there for vagrancy, and was under suspicion for burglarizing a a tool shed.
The victim in Stockton was so badly beaten he was unconscious for about 3 weeks. Sentencing was on 14 Feb 1917, the victim was still suffering from the wounds inflicted. He had a broken jaw, his face was cut, one eye was injured and he might loose his eyesight.
He was found in the store the following day from the robbery, by his neighbors.
Peschke was enlisted in the U.S. Navy 11 Aug 1915, he enlisted again served out 1 year and 9 months on a 4 year enlistment, when he over stayed his leave at Los Angeles and missed his ship. He ran out of money, worked at Hetch Hetchy, then was in Sacramento working for engineers. He ran a filling station. He said on the day of the crime he gambled all his money and lost and 5 hours later committed the crime. He was drunk.
Pardon denied 8 Aug 1919
He clearly might have had a life without crime if he wasn't drinking and hadn't missed his ship. He should of be charged for A.O.W.L. as well by the Federal Government and been placed in a Federal Prison after serving his 20 years in the state prison, and maybe he was as I couldn't find records for him or a death, but his Alias is a very common name.
He was very young when he committed his crime and could of been rehabilitated with the right program and help.
He would of been in his late 40's if he was ever paroled and made it out of prison a live.
He had not been married before going into prison so I would imagine that type of relationship to be hard one to manage later after getting out, unless he found a good stable wife that would not stand for him to drink as that was his issue for his troubles it seems.
If Peschke is his true name I didn't find his military records. His prison record states he was born about 1890 in Texas, but if he lied about his name he very well could of lied about the place he was born as well. I will keep search.
