Horace Elvin "Ebb" Whitehurst Born 12 Feb 1913 in Arkansas to Herber Odum Whitehurst and Donie Ahrendt.

Was arrested and convicted of sodomy and placed into the New Mexico Prison.

Arthur Lee Warner was born 8 Oct 1918 in Arkansas to William H Warner and Lulah Josephine Fortner.
He was arrested and convicted of Sodomy with his partner.

There are two reasons I know they were partners, one they were admitted into prison together and their Inmate numbers are #10583 & #10584. I also found a 1940 census listing them as partners living together. See below.




They however did not stay together after getting out of prison.

Horace got married on 29 Mar 1945 in Pima, AZ to Alberta Marie Winters born in 1923. They had a son born prematurely and died in 1953.

Horace died 15 Feb 1996 in Tuson, AZ

I didn't find any marriage records for Arthur Warner he died 18 Apr 1977 in Los Angeles, CA


But life as a homosexual in the 1940's was incredibly difficult. Gay activity was a court-martial offence, jail sentences for so-called "gross indecency" were common, and much of society strongly disapproved of same-sex relationships. At the time, not only was homosexuality illegal, but those in the armed forces could be shot for having gay sex. I feel so bad for these two men, and wanted to share their story. Stories like these are inspiring. It tells you the risks someone is willing to take for love.
