Bird claims self-defense, the newspaper doesn't explain much detail of the crime. He was originally charged with murder.

But in his brother's case it's very detailed even witness testimony was printed in the paper.

Franklin "Frank Joseph Smith was born 13 Mar 1875 in Fredonia, KS.

Inmate: #9623 Kansas State Prison
Rec: 31 Dec 1900
Crime: Murder

The man Frank murdered on 28 Oct 1899, Edward L Cotney.

The details are amazing, and their father was mentioned.

Bird was married to Kittie b Allen in Harris County, TX on 6 June 1943. He died 21 Aug 1954 in Odessa, TX.

He spent his early days as a miner.

Frank married Sharon Richards a widow, I didn't find her maiden name yet. They married in Yuma, AZ on 21 Aug 1932 and lived in Los Angeles, where Frank would die 15 Sep 1955.

He worked as a boilermaker.

He was in a Soldier's Home in 1930, by 1938 he was living high on the hog in Brentwood (Los Angeles). He was in the Spanish-American War.

Their father Alexander was a Civil War Veteran. He was a farmer and a carpenter.

I wonder how their father took this, it couldn't of been easy having two sons in prison at the sametime. Their mother died in 1889 I wonder if it was from the stress of her son, Franklin's trial. Heartbreaking nonetheless to go through so much in a short span of time.
