Dennis McCarthy: Murder 2nd Degree

Dennis McCarthy was born about 1857 in Ireland to Dennis McCarthy & Mary Coghlan. He had 2 brothers and one sister I know of, Jerry McCarthy, James McCarthy & Lanora McCarthy.

At 2 Am Peter Connoughton's Saloon, Granite Creek, Idaho, Dennis McCarthy and his best friend Jas. Dacey had a quarrel, but settled their difficulty, took a drink together and shortly after Dennis left the saloon and soon returned.
Several men left for Dinner and were a short distance way when they heard a shot and ran back to the saloon and found Dacey lying on the floor dead shot through the heart.
Dennis was a partner of Collin's and Mike Corcoran in a mining claim on Fall Creek, a brother-in-law to Mike. 
This is all that is know about the crime, what are your thoughts? I believe he got 2nd degree because it was not planed out in the eyes of the court or jury.

Dennis' brother Jerry who was born about 1855 was killed by a cave in on 18 May 1881 had a Placer claim over there 3 years prior. 

Dennis and Tim Dacey were best friends and were living together on Shafer Creek

Food for thought sometimes going into business with your best friend is not always a good idea, especially where theirs Gold or precious metals involved.


Dennis was paroled 6 Jun 1921, that was a life time in prison, could you imagine the culture shock when he walked away from those prison gates?
